Divorce
The prospect of dissolving a marriage may seem scary and costly and only you can decide if it is the right path to take for your future. We know that your focus is on protecting your kids and continuing to provide them with a safe and secure life.

Child Custody
When the parents of minor children have decided to terminate their marriage and/or initiate paternity proceeds, the courts will order child custody and visitation based on all the information submitted by both parties with consideration for that is “in the best interest of the child.”

Child Support
The purpose of child support is to allow for the custodial parent or parents to pay for all of the monthly expenses related to the care and wellbeing of the child or children of the relationship.

Guardianship
The court will order a Guardianship when an adult that is not the parent of the minor child is granted custody of the child, granted control of the child’s property, or both.

Child Visitation
The courts view child visitation and child support as two separate issues. Visitation promotes a healthy relationship between the noncustodial parent and their minor child, independent of the parent’s ability to provide mandated financial support. This is considered “in the best interest of the child.”

Temporary Orders
Temporary orders are orders filed by a responsible adult in cases where that person would like to get temporary custody or visitations with the child(ren). The temporary request would often get a person in front of the judge within a few weeks of filing, where the judge would hear both sides and then make a temporary ruling. That ruling would usually stay in place while the remainder of the case is pending through the courts. This is a great way to make sure that you can still remain in the child(ren)’s life while the court case is pending through the courts.

Paternal Rights
According to the law, parental rights include legal rights pertaining to child support, child custody, and visitation. These rights have been established to fulfill the parent’s legal responsibility to properly care for the child. This includes taking care of their financial, physical, and emotional well-being until they reach adulthood.

Paternity
Determining paternity is often one of the first steps in developing a solid parenting plan. Before child custody, child support, or visitation are addressed, the court needs to verify the identity of the father. Once done, the biological father’s rights and responsibilities regarding the child can be established and enforced.

Cooperation is key
Whenever possible, always try to be amicable with the other parent or guardian.
If children are involved in your divorce, you will eventually need to hammer out a custody and visitation schedule that works for everyone involved, including your soon-to-be Ex. Child support can be tricky as well, and it’s always helpful if you strive to cultivate a cooperative atmosphere.
All courts, regardless of the state you live in, prefer that parents or partners work out the details themselves. When the parties cannot come to an agreement, the court will get involved in order to protect the best interests of the child.
